Worldwide Fitness - Terms of Service

1. Acceptance of Terms:

By placing an order with Worldwide Fitness ("Seller"), you ("Buyer") agree to be bound by these Terms of Service. These terms govern all sales and transactions between Seller and Buyer.

2. Orders and Pricing:

• All orders are subject to acceptance by Seller.
  
• Prices quoted are subject to change without notice. Shipping quotes are valid for a limited time, as specified in the quote.
• Seller reserves the right to correct any errors or omissions in pricing or product descriptions.
• Buyer is responsible for ensuring the accuracy of all order details, including product specifications, quantities, and delivery address.

3. Payment Terms:

• Payment terms will be specified in the invoice.
• Payment is due according to the agreed-upon terms.
• Late payments may be subject to interest charges.
• Seller reserves the right to withhold shipment until full payment is received.

4. Shipping and Delivery:

• Shipping and delivery are subject to the terms outlined in our Shipping Policy.
• Risk of loss or damage to goods passes to Buyer upon delivery to the carrier.
• Delivery times are estimates and are not guaranteed.
• Buyer is responsible for providing accurate delivery information and ensuring someone is available to receive the shipment.
• Buyer is responsible for offloading the goods, unless otherwise agreed upon in writing. Offloading abilities, such as having a forklift, must be communicated to the seller.

5. Product Warranty:

• Seller warrants that products will be free from defects in materials and workmanship for the warranty period specified for each product.
• Warranty coverage is limited to repair or replacement of defective products.
• Warranty does not cover damage caused by misuse, abuse, negligence, or unauthorized modifications.
• Warranty claims must be submitted in writing with proof of purchase.
• Warranty is a back to base warranty, unless otherwise stated.

6. Returns and Exchanges:

• Returns are only accepted for defective products or errors in order fulfilment.
• Buyer must contact Seller within [Number] days of receiving the order to request a return.
• Returned products must be in their original packaging and in resalable condition.
• Returns may be subject to restocking fees.
• Exchanges are subject to product availability.

7. Limitation of Liability:

13. Entire Agreement:

• These Terms of Service constitute the entire agreement between Seller and Buyer and supersede all prior agreements or understandings.
